Worthington Group specializes in the construction of
‘Trusts'. These include Unincorporated Organizations, sometimes referred to as
‘Pure'-‘ Constitutional'- ‘Common Law' - and ‘Contractual' (Trusts),
Living Trusts, LLC's. and Charitable Trusts.
Over the past several years there are some whose objective it seems is to
criticize trusts because the word ‘Pure' is used when referring to ‘Trusts'.
Worthington Group to better educate those with interests in protecting assets
must set the record straight as to the word ‘Pure'.
Web Sites have been created to berate ‘Pure Trusts'. These Web Sites assume by
virtue of a word such as ‘Pure', that all ‘Pure Trusts' are Rebel Non-Filers
and Absurd Deduction Creators. The ‘Pure Trust' created by Worthington Group
adheres to USC 26 §671 through §679 as defined by Treasury Reg. §301-7701.
Obviously these purveyors of misinformation have never researched any
Regulation, Code, or Court Case which would support their theory.
Courts have been ruling for over 100 years as to ‘Pure Trusts', we cite a few
of these decisions.
Johnson v Lewis, 6 F 27 (1881) stated:
"Trustees of pure business trusts (not corporations) are
the owners of the trust property in a fiduciary relationship. A relationship of partners does not exist between certificate holders".
And;
Elliot v Freeman, 649 220 US 178 stated:
"A pure trust is not subject to legislative control. The
United States Supreme Court hold that trust relationship comes under the realm
of equity, based upon common law, and is not subject to legislative restrictions
as are corporations and organizations by legislative authority".
And;
Baker v Stern, 58 ALR 462 stated:
"It is established by legal precedent that ‘Pure
Trusts' are lawful, valid business organizations".
And;
Smith v Morse, (DC) 269 F 2d 135 stated:
"A pure trust is established by contract, and any law or
procedure in its operation, denying or obstructing contract rights impairs contract obligation and is, therefore,
violative of the United States Constitution".
These are just a few of the Court cases available which substantiate the legal
use of the word ‘Pure' when referring to ‘trusts'.
